Dhaka: Advocate Khandakar Mahbub Hossain said the decision of review petition will be taken after the publication and the analysis of the complete verdict and discussing with Matiur Rahman Nizami.

He made the comment as the appellate section of the Supreme Court had kept the verdict on Jamaat-e-Islami ameer Nizami’s execution unchanged on Wednesday morning (January 6).

An appeal bench of four members, lead by Chief Justice Surendra Kumar Sinha, gave a summarized final verdict of capital punishment for Nizami at 9:05am.

Other three justices were Justice Najmun Ara Sultana, Justice Syed Mahmud Hossain and Justice Hasan Foyez Siddiqui.

However, Nizami was charged with eight offences including the killing intellectuals, massacre and rape along with his superior responsibility.

The International Crime Tribunal (ICT) sentenced Nizami to death for four charges and life imprisonment for other four. Among them, the Appellate Division kept the verdict to hang the convict till death for three of the charges and life imprisonment for two.

While answering the questions of journalists, Khandakar Mahbub Hossain commented, “It should not certainly be said at this moment about the review application. Nizami may feel that he will not get justice through the review. Previously whoever asked for review didn’t receive justice. Therefore he may not apply for it”.

According to Khandakar Mahbub, Nizami and whoever others in trial now are just the associates of crime. The main war criminals are the 195 army officers of Pakistan.

“The collaborators are facing the justice instead of the main perpetrators”, he argued.

He further said, “Due to political believes, some people might have supported Pakistan. But that doesn’t mean that they had committed crimes like killing, looting or rapes”.

The lawyer also expressed suspicion over the witness and the evidences. He claimed that these witnesses were taught and kept in safe homes days after days and brought to the tribunal.

“The witnesses were forced to testify,” he added.
