DHAKA: The Supreme Court Appellate Division on Sunday (June 4) rejected the review petition against earlier verdict asking BNP senior leader Moudud Ahmed and his brother to leave their home holding plot no.159 in Gulshan-2.

Besides, the appellate division also scraped another appeal seeking review of charge forming cancellation against Moudud and his brother Monjur Ahmed, accusing of embezzling the home.

Therefore, the case would not run anymore, said the lawyers at the court. 
 
A five-member appeal bench led by Chief Justice Surendra Kumar Sinha passed the order in the morning.

The chief justice along with Barrister Rokon Uddin Mahmud and Kamrul Haque Siddiqui moved for Moudud while Attorney General Mahbubey Alam for the state and Abdul Matin Khasru and Khurshid Alam Khan moved for ACC at the court.

Earlier, the appellate division rejected a High Court order asking mutation of the house in the name of Monjur Ahmed. Besides, it also discharged Moudud and his brother Monjur Ahmed in a case charging them of grabbing the house.

However, ACC then filed a plea against cancellation of the case while Monjur Ahmed sought reviewing the verdict ordered by appellate division in another appeal.

The court then set June 4 for further hearing upon the pleas. 

Earlier, on August 12, 2010, the High Court (HC) ordered mutation of the house in the name of Manjur.

Later, Rajuk (Rajdhani Unnayan Kartripokkho) filed an appeal to the Appellate Division challenging the HC order.

After hearing the appeal, the Appellate Division scraped Manjur’s ownership of the house August 3, 2016.

However, on December 17, 2013, Deputy Director of Anti Corruption Commission (ACC) Harun-or-Rashid filed a case with Gulshan Police Station against Moudud and Manjur on charge of grabbing the house.
